Caleb is a reliable resource for these and more when confronted with human resources and employment law concerns, whether the goal is to avoid litigation or resolve it.

Caleb also advises on diversity, equity, inclusion and accessibility matters, helping clients to calibrate and implement strategies to achieve their DEI/IDEA goals from compliance to corporate social responsibility. 

Caleb draws upon his years of experience as associate general counsel for Advocate Health where he served as the primary attorney adviser to senior executives and the human resources department on labor and employment issues for the Atrium Health brand. Caleb most recently served as Advocate Health's vice president for teammate relations and executive services. He also has an employment litigation background from several years in private practice prior to his in-house roles.

Experience

Health Care Employment

  • Represented and advised as in-house counsel a national health care organization in a wide variety of employment matters involving executives, faculty, physicians, residents, advanced practice clinicians, clinical staff, non-clinical staff and other employees.
  • Represented and advised as in-house counsel a national health care organization on newly developing and evolving employment practices throughout the COVID-19 pandemic, including compliance with the Families First Coronavirus Response Act and other local and national emergency policies and regulations.

General Employment

  • Represents companies relating to the negotiation and finalization of employment contracts and separation agreements, both executive and non-executive.
  • Counsels companies in matters relating to restrictive covenants in employment, including non-competition, non-solicitation and non-disclosure agreements.
  • Counsels companies in matters relating to employment policies and practices, including the formulation of and/or updating of employee handbooks.
  • Counsels companies in matters relating to proper classification of employees and independent contractors.
  • Represents clients in matters pertaining to alleged violations of the North Carolina Wage and Hour Act, Fair Labor Standards Act, North Carolina Retaliatory Employment Discrimination Act, Americans with Disabilities Act (including allegations of failure to reasonably accommodate), Family Medical Leave Act, Pregnant Workers Fairness Act, Age Discrimination in Employment Act, Title VII of the Civil Rights Act, National Labor Relations Act, and Worker Adjustment and Retraining Notification Act.
  • Advises companies regarding employment issues arising from mergers and acquisitions and divestitures, including due diligence and risk assessments.
