Overview

Ethan White advises and represents clients in complex civil disputes. He maintains a diverse practice, including contract disputes, business torts, creditors’ rights, bankruptcy work, and loan restructuring. In addition, Ethan has experience throughout the litigation process, including preliminary motions, discovery, dispositive motions, trial preparation and appeals. He has represented and counseled clients across a variety of industries, including manufacturing, agribusiness, private investments funds and private security.

Ethan approaches each matter with a focus on his client’s needs and goals. He represents clients in federal and state court, and he is familiar with practice in the North Carolina Business Court. 

Experience

Appellate

  • Secured discretionary review from the North Carolina Supreme Court on the scope of a COVID-related immunity statute for health care providers.
  • Successfully argued appeal defending trial court’s order allowing tenant to bring debt collection claims against landlord.
  • Obtained reversal on appeal of an unfavorable trial court order relating to the administration of a deceased individual’s estate for a family member named as administrator in the will.
  • Won an appeal in the North Carolina Supreme Court on the rights of tenants under the federal public housing program.

Bankruptcy & Creditors’ Rights

  • Represented a Nasdaq-listed bank holding company that acquired all customer deposits and substantially all loans of a failed bank in multiple aspects of the Chapter 11 bankruptcy of the failed bank’s parent holding company filed in the U.S. Bankruptcy Court for the Southern District of New York.
  • Represents a credit union in post-bankruptcy litigation brought by debtor.
  • Advises a national perimeter security provider on navigating customer bankruptcies.

Complex Commercial Litigation

  • Represented a global agribusiness company in a lawsuit alleging breach of contract and business tort claims in the North Carolina Business Court.
  • Represents a large North Carolina-based manufacturer in alleged Sherman Act and other antitrust claims pending in federal court.
  • Helped obtained dismissal of an investor lawsuit against a business executive client in the North Carolina Business Court.
  • Defended a global infrastructure company in a putative class action in federal court alleging violations of ERISA and the LMRA relating to the provision of health benefits for retirees.
  • Assisted national shipping business in enforcing non-compete and confidentiality agreements in state and federal courts at the trial and appellate level.
