Allen O'Rourke is a seasoned litigator and trusted adviser. He has conducted more than 50 trials as well as numerous appeals, motion hearings and investigations in state and federal court. In particular, Allen represents clients affected by cybercrime and handles investigations and litigation arising out of cybersecurity incidents.
A former federal prosecutor, Allen assists clients in internal and government investigations, white-collar defense and general litigation. Leveraging his experience prosecuting cybercrime, he helps clients respond to data breaches and provides legal guidance in matters involving digital forensics and complex information and communications technologies. Allen also counsels clients on cybersecurity and privacy laws and digital advertising, especially with regard to expanding data protection laws in the United States and Europe. He co-chairs the firm's Cybersecurity and Privacy Practice Group.
Before private practice, Allen helped lead the Cyber Unit at the U.S. Attorney's Office in Washington, D.C., and received two Special Achievement Awards for his work to combat cybercrime.

Successfully defended a bank employee charged with 28 counts of bank fraud, misapplication of funds and conspiracy, obtaining a directed verdict of acquittal after a nearly month-long jury trial in federal court.
Represented a large manufacturing company regarding an attempted ransomware attack, directing their response to thwart the attack and subsequent forensic investigation, advising on relevant legal obligations and strategy, and handling several government investigations related to the incident.
Represented a nonprofit impacted by an internet fraud scheme misusing its trademarks and good will, helping develop a mitigation strategy and build a case to enable law enforcement intervention.
Conducted an internal investigation of cybercrime and successfully helped a technology company recover significant funds that had been stolen through a business email compromise scheme.
Advised an advertising technology company on privacy by design, managing HIPAA de-identification, and complying with the Digital Advertising Alliance principles and related self-regulatory frameworks.
Advised a financial services company regarding compliance with Europe's GDPR and California's CCPA.
Advised multiple technology and telecommunications companies regarding law enforcement requests for customer data under the Electronic Communications Privacy Act.
Routinely advise clients on their cyber incident response plans, and participate in tabletop exercises for data breach preparedness.
As a prosecutor, led numerous criminal investigations into corporate data breaches, business email compromise schemes, "dark web" criminal forums, money laundering using Bitcoin, terrorist use of the internet, cyberstalking and other cybercrime, and handled related national security investigations requiring Top Secret security clearance.
As a prosecutor, conducted 16 jury trials, including emotionally charged felony domestic violence trials and armed robbery and kidnapping trials, and presented and cross-examined hundreds of witnesses during trials or before grand juries.
