In-house counsel face a complex web of issues when the prospect of an internal investigation arises. Robinson Bradshaw litigators and in-house counsel at First Citizens Bank walked through the preliminary decisions about whether to conduct an investigation at all, who should conduct and supervise an investigation, and how best to report on and document an investigation. They also addressed tricky issues that can arise, including privilege, experts, confidentiality, investigations involving company executives, and the overlap of investigations and public relations.
