Fitz Barringer Discusses Fourth Circuit Wage and Hour Standing Decision with Law360
Robinson Bradshaw attorney Fitz E. Barringer discussed a recent Fourth Circuit decision with Law360 holding that a plaintiff who settles his individual claims lacks standing to appeal a class and collective action decertification order.
The article examined the implications of the ruling for class and collective action litigation and the need for parties to maintain a continuing stake in the case through appeal. Barringer noted that if class attorneys intend to appeal a class decertification order, they must ensure that one or more named plaintiffs do not relinquish their underlying claims.
Barringer's practice at Robinson Bradshaw includes advising clients in the resolution of complex commercial disputes and employment litigation, including class action and wage and hour matters. He co-chairs Robinson Bradshaw's Employment & Labor Practice Group.
