Overview
Emma Kutteh counsels companies and executives through high-stakes business disputes. She has litigated in state and federal courts across the country, routinely defending clients involved in class actions and multidistrict litigation.
In addition to her class action and multidistrict litigation experience, Emma has represented clients in antitrust, commercial fraud, employment discrimination and other business matters. She also counsels clients involved in federal criminal investigations and civil enforcement actions. Outside of the courtroom, Emma assists companies in obtaining antitrust clearance for significant mergers and acquisitions.
A certified public accountant and former auditor, Emma brings particular experience to matters involving complex finance and accounting issues.
Experience
Complex Commercial Litigation
- Represents major financial services institutions in multidistrict putative class actions resulting from what is alleged to be one of the largest Ponzi/pyramid schemes in U.S. history.
- Represents a publicly traded, multinational company in litigation, including a nationwide MDL, related to PFAS (per- and polyfluoroalkyl substances).
- Defends a large manufacturing company in nationwide class action litigation involving antitrust claims brought by direct and indirect purchasers of PVC pipe.
- Represented a national fast-food chain in defense of a wage and hour class action consisting of more than 5,000 employees who assert claims of off-the-clock work.
- Obtained, on behalf of the world’s largest pork processor, dismissal of a fraud claim brought in the North Carolina Business Court.
Antitrust (Transactions)
Regularly assists clients in advising on and obtaining antitrust clearance for significant transactions, including:
- An industrial technology company in the acquisition of an advanced manufacturing business focused on the semiconductor value chain.
- An agricultural company in the review of potential strategic acquisitions.
- An industrial technology company in antitrust issues related to a potential transaction in the aerospace industry.
Investigations
- Regularly represents a variety of clients in civil and criminal government investigations, including investment management, health care, manufacturing and technology companies.
