Overview

The North Carolina Business Court was created to handle complex corporate disputes in North Carolina. Since the court's founding more than 20 years ago, Robinson Bradshaw lawyers have been at the forefront of representing clients in the Business Court and, in the process, developing the law that governs business disputes in the state. Our firm's deep bench of experienced trial lawyers has unparalleled experience with the Business Court and its specially designated judges, and we regularly help clients both within North Carolina and outside of the state navigate the nuances of this specialized forum.

Modeled in part on the Delaware Court of Chancery, the Business Court is designed to handle complex and significant issues of corporate and commercial law including:

  • Trademarks and intellectual property
  • Software, information technology, data security and biotechnology
  • Contract disputes involving businesses when the amount in controversy is at least $1 million

Experience

  • Obtained dismissal on behalf of a hospital in a case involving allegations of breach of contract, interference with contractual relations, and unfair or deceptive trade practices stemming from an insurance dispute. 

  • Represent a national trust company in defense of claims arising out of allegations of wrongdoing by an account holder's investment adviser.

  • Represented a university system and member institutions in securing the dismissal of trade secret misappropriation claims related to the use of a database license agreement.

  • Represented an asset management firm in lawsuits arising out of placement agent services for an investment fund.

  • Obtained the dismissal of investors in a professional school from multiple lawsuits filed by former students in the U.S. District Court for the Western District of North Carolina and the North Carolina Business Court. 

  • Obtained expedited injunctive relief via a temporary restraining order and preliminary injunction on behalf of a transportation and logistics company in a case involving noncompete, confidentiality and trade secret obligations.

  • Won a lengthy trial on trade secret misappropriation and related claims, which resulted in a $7 million jury verdict with potential for treble damages and settled prior to entry of judgment.

  • Argued before, and obtained opinion from, the North Carolina Supreme Court affirming the Business Court's dismissal of all claims against a client arising from a software agreement. 

  • Represented petitioners-taxpayers in a dispute over domicile following the sale of the petitioners' company. Petitioners prevailed at trial, and the North Carolina Business Court and North Carolina Court of Appeals affirmed the trial court ruling.

  • Represent defendants against a 10-count complaint stemming from a former employee's termination, including breach of contract, fraud, securities violations and wrongful termination allegations.
