Robinson Bradshaw's David M. Schilli and Andrew W.J. Tarr participated in the 37th North Carolina Annual Bankruptcy Institute held at the Omni Grove Park Inn in Asheville on November 7-8.

Mr. Schilli co-presented "A Primer on the Bankruptcy of LLC Members – The Only Certainty is Uncertainty" with Algernon Butler of Butler & Butler.  The presentation provided practical advice about the impact on an LLC, its members and their interests when a member becomes a debtor and explored issues involving property of the estate, the effect of the automatic stay, classification of operating agreements as executory contracts, and efforts by estate representatives to monetize LLC interests. The presentation delved into state law rights and remedies, including charging orders and the impact of recent changes to the NC LLC laws.

Mr. Tarr served as the Program Planner for the event.
