Overview
Lani Barnes Baxter practices intellectual property law, with a focus on trademarks and copyrights. She counsels clients on trademark prosecution and licensing matters, including both domestic and international trademark clearance, registration, maintenance and enforcement, as well as copyright prosecution and protection. Lani also advises clients on the strategic selection and development of brands and marketing matters, such as advertising review and clearance, sweepstakes, contests, promotions, influencers and social media.
Lani represents corporate clients in a variety of industries, including craft beer, textiles, retail, insurance, financial services, consumer products, construction products, health care and software.
Prior to joining the firm, Lani served as in-house counsel for LF USA Inc. and Springs Global US Inc., where she gained extensive experience with an emphasis on intellectual property, commercial contracts, regulatory compliance, and marketing and advertising matters.
Experience
- Prosecutes and maintains trademark portfolios for various sports clients, including JR Motorsports (Dale Earnhardt Jr.), Kyle Larson, High Limits Racing, Kevin Harvick, Martin Truex, CARS Tour, Bubba Wallace, Martin Truex, Shane van Gisbergen, John Hunter Nemechek, William Sawalich, Corey Heim, RFK Racing, Ray Evernham Enterprises, IROC, MotoAmerica and the Southeastern Conference.
- Manages global trademark portfolios for numerous clients, including the largest independent wholesale distributor of specialty insurance and the top privately held over-the-counter health care manufacturer.
- Represented various athletes on the selection and development of their brands related to products outside of sports, including apparel lines, wine and hotels.
- Routinely assists clients, including a family of best-in-class craft beverage companies, with trademark and copyright infringement matters, including drafting and responding to cease and desist letters and negotiating consent or coexistence agreements.
- Regularly advises clients regarding advertising clearance requirements, claim substantiation, sweepstakes, contests and nonprofit raffles.
- Represents clients in the purchase, sell and licensing of intellectual property.
- Assists designers and companies who hire designers with design services and licensing agreements
