Robinson Bradshaw Wins Landmark N.C. Supreme Court Case Over Separation of Powers

In a historic case over separation of powers, Robinson Bradshaw secured a victory in the North Carolina Supreme Court today on behalf of Gov. Pat McCrory and former governors Jim Hunt and Jim Martin. In a 6-1 decision, the court affirmed the Superior Court’s previous ruling, stating that "the legislative branch has exerted too much control over commissions that have final executive authority. By doing so, it has prevented the Governor from performing his express constitutional duty to take care that the laws are faithfully executed." Robinson Bradshaw attorneys John R. Wester, David C. Wright III and Andrew A. Kasper represented the governors in this case.
