Overview

Nathan Chase's practice focuses on complex business disputes, client counseling and internal investigations. He has extensive experience in antitrust litigation and enforcement actions, including defending clients in nationwide antitrust class actions and representing clients in connection with antitrust investigations conducted by the Department of Justice, Federal Trade Commission and state attorneys general. Nathan also advises clients with regard to antitrust issues raised by distribution arrangements, minimum advertised price (MAP) policies and Robinson-Patman issues. He also regularly conducts antitrust law trainings for clients.

Beyond his antitrust work, Nathan represents clients in complex business disputes in state and federal courts around the country.

Nathan serves as co-chair of the firm’s Litigation Department. Before joining Robinson Bradshaw, Nathan practiced with Gibson Dunn & Crutcher in Palo Alto, California.

Antitrust & Competition

  • Defends a PVC pipe and fittings manufacturer in a nationwide antitrust class action, In Re PVC Pipe Antitrust Litigation (N.D. Ill.).
  • Represents defendant in a nationwide antitrust class action in the turkey industry, In Re Turkey Antitrust Litigation (N.D. Ill.).
  • Defended a large drywall manufacturer in multidistrict, nationwide class action litigation involving antitrust claims brought by direct and indirect purchasers, In Re Domestic Drywall Antitrust Litigation (E.D. Pa.).
  • Defended a cast iron pipe manufacturer in multidistrict nationwide class action litigation involving antitrust claims, In Re Cast Iron Soil Pipe and Fittings Antitrust Litigation (E.D. Tenn.)
  • Defended the largest health care provider in the Carolinas in a suit in the North Carolina Business Court involving antitrust and trade secret claims.
  • Represented a manufacturing client in an industry-wide, price-fixing investigation by the Department of Justice. No charges were brought by the Department of Justice arising out of the investigation.
  • Advises a large health care provider in connection with antitrust implications of proposed acquisitions.
  • Advises clients regarding distribution agreements, MAP policies, pricing policies, gun-jumping and Robinson-Patman issues.

Complex Business Litigation

  • Represented a major health insurer in a multibillion-dollar protest of contract award, culminating in two-week administrative trial.
  • Represents a major health care system in litigation related to organ transplant organization. Secured denial of preliminary injunctive relief.
  • Represents clients in arbitrations related to manufacturing and contractual disputes.
  • Represents clients in defense of putative class actions asserting claims arising from cyberattacks.
  • Represented the Special Litigation Committee formed to investigate fraud and corporate waste claims.
  • Defends clients in multiple class actions involving alleged violations of Telephone Consumer Protection Act.
  • Obtained an arbitration award confirmed in North Carolina state court in favor of clients for recovery of investment in limited liability company.
  • Defended a major financial institution, which arranged multiple financings for a defunct entity, in actions by bondholders, senior secured lenders, a bond trustee and a liquidating trustee in bankruptcy.
  • Represented a major bank and its directors and officers in obtaining the dismissal of a shareholder derivative action relating to the auction rate securities market.

Pro Bono

  • Led the development and statewide distribution of educational materials regarding identity theft through Antitrust and Complex Business Disputes Section of North Carolina Bar Association.
  • Represents clients in landlord/tenant disputes.
