Overview

Nathan Chase's practice focuses on complex business disputes, client counseling and internal investigations. He has extensive experience in antitrust matters, including defending clients in nationwide antitrust class actions and representing clients in connection with antitrust investigations conducted by the Department of Justice, Federal Trade Commission and state attorneys general. Nathan also counsels clients with regard to antitrust issues raised by distribution arrangements, minimum advertised price (MAP) policies and Robinson-Patman issues. He also regularly conducts antitrust law trainings for clients.

In addition to his antitrust practice, Nathan represents clients in complex business disputes in state and federal courts around the country and conducts internal investigations on behalf of public and private companies with regard to accounting, employment, and other issues.

Nathan co-chairs the firm's Litigation Department. Before joining Robinson Bradshaw, he practiced with Gibson Dunn & Crutcher in Palo Alto, California.

Experience

Antitrust & Competition

  • Defends largest health care provider in the Carolinas in a suit in the North Carolina Business Court involving antitrust and trade secret claims.

  • Advises large health care provider in connection with antitrust implications of proposed acquisitions.

  • Advises clients regarding distribution agreements, MAP policies, pricing policies, gun-jumping and Robinson-Patman issues.

  • Defended large drywall manufacturer in multidistrict, nationwide class action litigation involving antitrust claims brought by direct and indirect purchasers.

  • Defended large cast iron pipe manufacturer in FTC investigation and multidistrict nationwide class action litigation involving antitrust claims brought by direct and indirect purchasers.

  • Represented manufacturing client in industry-wide, price-fixing investigation by the Department of Justice. No charges were brought by the Department of Justice arising out of the investigation.

  • Represented Fresenius Medical Care in it $2 billion acquisition of NxStage Medical Care Inc.

Complex Business Litigation

  • Defended media company in multiple class actions involving alleged violations of Telephone Consumer Protection Act.

  • Obtained arbitration award confirmed in North Carolina state court in favor of clients for recovery of investment in limited liability company.

  • Defended major financial institution, which arranged multiple financings for a defunct entity, in actions by bondholders, senior secured lenders, a bond trustee and a liquidating trustee in bankruptcy.

  • Represented major bank and its directors and officers in obtaining the dismissal of a shareholder derivative action relating to the auction rate securities market.

  • Represented employers and employees in litigation regarding noncompete agreements and other restrictive covenants.

  • Drafts and assists with implementation of record retention policies for corporate clients.

Pro Bono

  • Led development and statewide distribution of educational materials regarding identity theft through Antitrust and Complex Business Disputes Section of North Carolina Bar Association.

  • Represents clients in landlord/tenant disputes.
