Overview

Andy Tarr is co-chair of the firm’s Bankruptcy & Creditors’ Rights Practice Group. His practice focuses primarily on bankruptcy and creditors’ rights, Article 9 foreclosures, business loan workouts, and business and real estate litigation. Andy represents private credit companies, banks, private equity companies, portfolio companies and purchasers in complex financial restructuring matters, including inside and outside of Chapter 11 bankruptcy and other insolvency proceedings. He also represents commercial landlords and trade creditors in all aspects of Chapter 11 and other financial restructuring matters. Andy calls on over two decades of courtroom experience in litigation and bankruptcy to provide creative strategies that produce efficient, effective resolutions.

Andy has lectured on various bankruptcy topics at state and local conferences. He also has served as chair of the North Carolina Bar Association’s Bankruptcy Section, as well as many other leadership roles for the Bankruptcy Section.

Experience

Representative Bankruptcy Engagements

  • Represented a Nasdaq-listed bank holding company that acquired all customer deposits and substantially all loans of a failed bank in all aspects of the Chapter 11 bankruptcy of the failed bank’s holding company filed in the U.S. Bankruptcy Court for the Southern District of New York.
  • Represented multiple debtors in separate and unrelated Chapter 11 cases filed to permanently, globally and fairly address asbestos claims through a reorganization plan that includes a channeling injunction under Bankruptcy Code § 524(g).
  • Represented a landlord and its affiliates in the multi-debtor Chapter 11 cases involving iHeart Media concerning their claims, real estate lease assumption and rejection issues, and cure amounts.
  • Represented Marriott International in the Chapter 11 bankruptcies of several hotels in North Carolina, negotiating bankruptcy sale process orders that preserved the franchise at those hotels while protecting the company and its valuable intellectual property and customer information.
  • Represented the agent for a secured lender group in the Chapter 7 bankruptcy filings of a network of pain treatment clinics in North Carolina and South Carolina that filed bankruptcy in the midst of fraud and false claims lawsuits.
  • Represented a mall with over a million square feet of gross leasable area in a receivership in which the mall was successfully sold free and clear of all claims.
  • Represented private equity company in its strategic acquisition of substantially all assets of a full-service commercial waste pickup and roll-off rental business free and clear of all claims from a court-appointed receiver.

Representative Out-of-Court Restructurings and Workouts

  • Represented a private investment client in the out-of-court acquisition and restructuring of a group of manufacturing portfolio companies in the manufacturing sector.
  • Represented a Fortune 500 company in the litigation and workout of its multimillion-dollar investment in a mixed-use real estate development.
  • Represented a private investment fund in the acquisition of its distressed borrower’s hotel property, including preservation of the franchise.

Representative Business Litigation

  • Served as trial counsel for major regional state-chartered bank in multiparty lawsuit involving breach of fiduciary duty and unfair trade practices claims arising from administration of a trust; lawsuit was pending in the North Carolina Business Court and settled during trial.
  • Procured a multimillion-dollar arbitration award for a regional convenience store chain in a supply agreement dispute against a global oil company.
  • Procured a multimillion-dollar judgment and dismissal of all counterclaims for a national landlord in a commercial lease dispute with its tenant.
  • Represented a commercial tenant to favorably resolve a multimillion-dollar lawsuit brought by its landlord.
