Overview
Spencer Wiles is an experienced business litigator focusing on complex disputes across a wide array of settings, with an emphasis on construction, insurance, land use, sports and entertainment, real estate and employment law. He represents clients in both litigation and arbitration, with a strong focus on resolving construction-related issues, including defect, delay and payment disputes.
In his insurance coverage practice, Spencer exclusively advocates for policyholders, offering strategic counsel on coverage disputes and needs. He also maintains a diverse sports and entertainment practice, where he’s successfully handled disputes in the motorsports industry, other professional sport leagues and college athletics.
Spencer is a trusted adviser to employers, providing guidance on a variety of workplace issues and conducting internal investigations.
Licensed in both North Carolina and South Carolina, Spencer has extensive experience at all stages of litigation in both federal and state court, as well as arbitration.
Experience
Construction
- Successfully represented an EPC contractor in a multiweek arbitration in regards to claims brought by an owner over the conversion of a paper mill.
- Advised the developer of a high-end multifamily and townhome project in the arbitration of complex claims concerning the delayed delivery and completion of the project by a contractor.
- Advises the owner of a historical multifamily renovation project in the litigation of claims concerning the delayed delivery and completion of the project, as well as various defects in construction.
- Represents a national general contractor in litigation defending against claims brought by the owner of a luxury multifamily project related to various alleged defects on the project.
- Represents a developer of a retail and multifamily complex in connection with construction defect claims and various claims asserted by a subsequent purchaser.
- Represented a national developer in litigation over structural issues related to construction and design issues in a commercial parking deck project.
Sports and Entertainment
- Represents motorsports teams, drivers and sponsors in disputes involving driver replacements, sponsorship agreements and intellectual property issues.
- Obtained summary judgment on behalf of a university in claims brought by former student-athletes alleging breach of contract, tortious interference and defamation.
- Represented a national university in a successful pre-litigation mediation related to Title IX allegations made by student-athletes.
- Represented a national university in the successful resolution of an amendment to a multimedia rights agreement affected by COVID-19.
- Negotiates various agreements representing professional teams, sponsors, athletes and player agents.
Complex Business Litigation
- Represented an insured party in a property insurance coverage lawsuit in the North Carolina Business Court involving a claim in excess of $26 million.
- Represents an insured party in connection with a breach of representations and warranty coverage arising from a merger of an international company.
- Secured a preliminary injunction in state court enforcing a nationwide noncompetition agreement for an industrial air filtration client and prohibiting a former executive from working for a direct competitor.
- Advised a national health care business in a federal case against a regional hospital involving breach of contract and unfair business practices.
- Represented an asset management firm in a federal case against a placement agent involving breach of contract, fraud and unfair business practices.
- Represents property owners and developers in condemnation proceedings brought by municipalities and state agencies.
- Represents employers in agency proceedings and litigation involving discrimination and other employment claims.
