Overview

Stephen Feldman represents clients in a range of complex matters, including business disputes, antitrust litigation, product-liability cases and appeals.

Stephen's recent experiences include representing the manufacturer of firefighter protective gear in multiple federal class actions, defending an agriculture business accused of price-fixing, defending a state agency alleged of violating federal and state antitrust laws, representing a pharmaceutical company in federal multidistrict litigation, serving as trial counsel for a North Carolina health care entity in government litigation and defending financial institutions in putative class actions.

Stephen’s practice often involves matters in the North Carolina Business Court. The Business Court appointed Stephen to lead a committee that rewrote the court's rules. He has served on the leadership of the North Carolina Bar Association's Antitrust and Complex Business Disputes Section and as chair of the association's Appellate Practice Section. From 2015-18, he led the American Bar Association's Appellate Practice Committee.

Stephen regularly writes and speaks on issues related to complex litigation, including the law on unfair trade practices and techniques for clear legal writing.

Experience

Complex Business Disputes

  • Represents the seller of an oil company against allegations of fraud in connection with the sale.
  • Obtained summary judgment for a science company in a contract dispute brought by a former executive.
  • Obtained injunctive relief for a health care software company to prevent theft of confidential information.
  • Persuaded a federal court to set aside an $8 million verdict as new counsel at the post-trial stage.
  • Attained a favorable settlement for a prominent financial institution in a putative class action in the North Carolina Business Court concerning allegedly unlawful fees.

Antitrust Litigation

  • Represents a state health care licensing board against antitrust allegations.
  • Represents an agriculture business accused of price-fixing in a federal multidistrict litigation.
  • Successfully defended a North Carolina licensing board in a scope-of-practice dispute initiated by a sister licensing board, which culminated in a unanimous opinion by the Supreme Court of North Carolina.
  • Obtained dismissal of claims against the North Carolina licensing board accused of antitrust violations.

Product Liability litigation

  • Represents a product manufacturer in federal multidistrict litigation and nationwide class actions concerning the alleged toxic effects of products.
  • Defends a pharmaceutical company in federal multidistrict litigation and related appeals against claims of personal injury from the administration of a vaccine.

Appeals

  • Won a unanimous decision from the North Carolina Supreme Court on an issue of first impression involving the interpretation of an insurance statute.
  • Prepared an amicus brief on behalf of former prosecutors in support of a lawsuit expanding voting rights for felons who completed their terms of incarceration.
  • Prepared an amicus brief on behalf of a public-interest group in support of a lawsuit to invalidate North Carolina statutes that discriminate against persons in same-sex relationships.
