Overview
Kate Maynard serves as Robinson Bradshaw's general counsel. She advises the firm on legal issues including ethics and professional responsibility, conflicts of interest, risk management and compliance, and privacy and cybersecurity. Kate provides training to the firm's attorneys and staff regarding these topics, and she speaks at seminars and programs for clients and the bar.
Kate is an experienced litigator, with past work on behalf of clients in complex commercial disputes, corporate governance disputes, governmental investigations and financial services litigation. She also has experience representing landowners in eminent domain cases, including successful jury awards in condemnation cases.
Kate is accredited through the International Association of Privacy Professionals as a Certified Information Privacy Professional for the United States (CIPP/US) and Europe (CIPP/E) and as a Certified Information Privacy Manager (CIPM).
Experience

Represented a national bank in successful appeal to the U.S. Supreme Court regarding statutory constructive of federal jurisdiction statute. Wachovia Bank N.A. v. Schmidt, 126 S.Ct. 941 (2006).

Represented a major financial institution that arranged multiple financings for a defunct entity in defending suits in New York, Los Angeles and Pittsburgh filed by bondholders, senior secured lenders, a bond trustee and a liquidating trustee in bankruptcy.

Successfully defended public company and its directors in North Carolina Business Court suit seeking injunctive relief in connection with pending merger.

Represented lender in litigation concerning obligations to provide financing under terms of commitment letters during 2008 credit crisis, including expedited discovery and proceedings before the Delaware Chancery Court.

Defended several dozen related financial products lawsuits in various states on the East Coast, from New Jersey to Florida.

Represented public company in its hostile battle with a former suitor over company's announced merger and shareholder challenge to merger terms.

Represented a company in asserting claims against a former officer for breaches of fiduciary duties and defense of related claims by minority shareholders against current management. This case involved the personal bankruptcy of the former officer, a derivative lawsuit and related civil actions.

Represented clients in condemnation proceedings with local and state condemning authorities.

Obtained $1.3 million jury verdict in condemnation action arising out of highway widening project. The Department of Transportation’s original deposit estimating just compensation in this case was under $100,000.
